Karnataka HC upheld states banned on wearing Hijab

HC upholds hijab ban by Karnataka colleges. The Karnataka high court on Tuesday, March 15th 2022 dismissed petitions filed by a section of Muslim students from the Government Pre-University Girls College in Udupi, seeking permission to wear Hijab inside the classroom. The matter was heard by a bench comprising Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit and Justice JM Khazi. HC upheld the order restricting students from wearing any religious cloths inside educational institution's premises.

In its interim order on February 10, the Karnataka HC had restrained students from wearing wearing saffron shawls, scarfs, hijab, religious flags or the like, within the classroom till the final order was delivered. Which was delivered yesterday. 

The full bench of the Karnataka High Court, which concluded its hearing in the Hijab case, ‘that wearing Hijab is not essential to Islam and also noted that the state govt. has power to issue an order in this regard.’-HC.  Ahead of the verdict, prohibitory orders Under Section 144 of the Code of Criminal Procedure were imposed in parts of Karnataka, including Bengaluru. The demand by a section of girls in an Udupi pre-university college to wear Hijab inside their classrooms erupted into a major row after some Hindu students turned up in saffron shawls with the issue spreading to other parts of the state, even the western media is covering this issue.Though the government insisted on a uniform norm.

Mainwhile reacting to the HC order, Karnataka Chief Minister Basavaraj Bommai appealed to respect HC verdict. “All students should follow the high court order and should not boycott classes or examinations. We will have to abide by the court orders and will take strict action against those who would take law and order in hands." Bommai said.

After Karnataka High Court's judgments many welcome court's judgment and asked others to respect Karnataka HC's judgment on the other hand many others show dissapointment. 

So, this matter came to an end atleast legally but the issue still continues to remain a controversial topic and this Hijab Issue likely to move to SC.
